Judge Says Man's Too Fat to Adopt One man is going to medical heights to try and get custody of a baby they call their son.

Gaury Stocklaufer arrived in Dallas on Wednesday for pre-surgery tests. That's because weight has been an issue in adoption proceedings.

Dallas doctors have offered their help in getting Gary Stocklaufer's adopted son back.

On Wednesday he will be screened for bariatric stomach surgery.

Stocklaufer weighs over 500 pounds and he said a judge denied him adoption because of his weight.

Stocklaufer told FOX 4 the court-appointed guardian has filed a motion to stop the re-hearing of the case.

The 34-year-old man hopes the weight loss surgery will help him get Max back, a baby a relative asked him to adopt because they couldn't afford Max.

The Stocklaufer's said what should have been a simple adoption has turned into a family nightmare because the court took the baby away.

"The judge or commissioner takes this up, please give us the chance that we deserve," said Gary Stocklaufer. "I want my son home. Look what steps I as a father is willing to go to get my son home."

According to Cheri Simpkin, the court appointed guardian in the case, the adoption was denied because there was a concern that Stocklaufer may develop diabetes or sleep apnea.
