Ok...I know it might be odd for me to post a family issue here but I need input and alternative points of view.
Here's my story: Five years ago my cousin got himself into a bit of trouble with his frat brothers. He had made a bad investment on some bad advice and lost much of their money. According to my cousin (who I will hence forth call Lenny) they were threatening to beat the tar out of him if he didn't get their money back asap. Poor scared Lenny can't go to his parents because they are already in debt up to their eyebrows just trying to put his sorry butt through school (his third by this point). Lenny calls my mother and cries to her for his life. She doesn't have all of the money but guess what? Kindly Cousin Nancy does. He pleads with me and my heart goes out to him. I loan him the money.
To make a long story short...it is five years later and I have not received a penny in payment. His excuses are many and some are understandable...or they were 3 years ago. I have now lost my patients. Lenny is no longer a college kid. He lives on his own and works full time. A month ago I emailed him demanding only a portion of the money by the end of June. He emailed me back saying he would send me a portion of the portion and give me the rest of the portion by July 14. Well, it is now July and I haven't even seen a portion or a penny and no contact. He had dicked me around like this before but I'll not willing to let it slide anymore.
Here is my dilemma...I have no problem getting ugly with Lenny. However, I have a real problem with this involving my other family members. I don't want my Aunt and Uncle hurt by any actions I might take against Lenny.
Bottom line...Should I take legal action against Lenny and risk upsetting my extended family? If yes what can I go legally to get my money back? I'm from Jersey so busting his kneecaps is not totally out of the question but it would upset my grandmother.
Any and all advise is welcome.
