Your images may be fair game for comedy (and faux comedy, like Leno's)....
"ROCHESTER, NY, United States (UPI) -- New York`s state appeals court has dismissed a lawsuit filed by an Irondequoit, N.Y., woman against the 'Tonight Show' host Jay Leno and NBC.
Claire Walter, 40, sued Leno, the show and the network for mocking a picture of her during a 2003 broadcast, the Rochester (N.Y.) News Democrat and Chronicle reported Saturday.
Leno obtained the photo of Walter from her employer at the time, Dorschel Automotive Group Inc., which had a caption at the bottom that said: 'Something Wrong with your car?'
Walter`s lawsuit said Leno called her 'scary and big' and wondered why anyone would let her service their car. The appeals court ruled Leno was allowed to use the photo under an exception for comedic purposes under the Civil Rights law.
However, the panel said Dorschel Automotive was not exempt from the law and let Walter`s suit against her former employer continue.
Her attorney, Nira Kermisch, said Leno 'destroyed' her client.
'Just because you`re a comic doesn`t give you the right to take someone who is an obscure person and make fun of the way someone looks,' she said. 'It`s very devastating.'
